With reference to letter XXXXX dated on 22 Jan 2014,
COMPANY has made a very thorough review to the remaining scope of work inside
YNGL and found that CONTRACTOR can do more progress and achieve end of February
work completion date. There are many open front activities have been identified
(See attached) can be achieved however CONTRACTOR is reluctant due to the fact
of shortages of manpower and material.
The following are some items, but not limited to, need immediate
action by CONTRACTOR to expedite the work progress:
1. Metering area Electrical and
Instrument cables :
Excavation, backfill and reinstatement of road crossing to SIH-151 and
SS-150.(MS and JSA not approved. No action.)
2. Battery limit MOV :
Excavation, backfill and reinstatement of road crossing for instrument
cable from north of existing FW tank V83-T-701B to SIH-172. (No manpower.
Excavation request to be submitted for approval.)
3. YNGL North Perimeter Fence Crossing
:
Excavation, backfill and reinstatement of road crossing for UG piping passing
through YNGL North Perimeter Fence.(No manpower. Excavation request to be
submitted for approval.)
4. FW System :
Provision of concrete collars for the PIVs and hydrants, foundations for
the hose reels. Risers need to be modified.
5. Fiber Optic and Control Cable
Installation:
4 no. of Fiber optic cables and 1 no. of Control
Cable pulling , splicing and termination are remaining from New Metering
Shelter to SIH-151 & 211 metering, Material is available. (Waiting for
trench readiness).
6. Switches for Pumps Installation:
Installation of three (3) switches for pumps are
missing. Material not available.
7. Local Control Panel Installation:
One Local Control Panel Installation is remaining.
Material is available.
8. ZVs Volume Tank Installation:
Installation of seven (7) Volume tank for ZVs NOT
completed.
9. Instrument Cable for MOV at Battery
Limit Area connected with ESD system inside SIH- 172:
Excavation of instrument cable (200 m) for MOV NOT
started. Also, termination is remaining.
10. Site Acceptance Test ( SAT ):
Site Acceptance Test for Systems at New Metering
Shelter is remaining, SERVER is not
available.
11. Tie-in & Hydro test packages.
12. Electrical work inside SS# 150: cable
pulling, Glanding and Termination and MCC Installation are remaining, required existing
Cubicle shutdown. Material is available. Awaiting contractor for MCC schedule.
COMPANY again stresses the importance and Contractual requirement
of completing the OCI Scope of Work as scheduled to avoid any schedule delay
that may jeopardize the whole program completing date.

COMPANY
maintains its position that executed its contractual right to suspend any
portion of the work and it remains. CONTRACTOR shall be reminded that due to
his continues delays from the original contractual base schedule and his
inability to finish the work activities on time, he exposed himself to regulation
shift risk that COMPANY shall not be responsible to be liable for.
Nevertheless,
CONTRACTOR was requested to relocate the impacted resources to support other
work fronts inside Jetty, YR Tank Farm, YNGL and Samref to complete them by Dec
30, 2016 as promised; however, none of them is completed and still progressing slowly.
Moreover, As per COMPANY verified site monitoring, there were no major
equipment idle at site or material laydown areas that required dedicated
safekeeping and protection and CONTRACTOR did not submit his daily reports to
COMPANY to be authenticated if a dedicated safekeeping and dedicated protection
was needed.
Therefore,
COMPANY concludes that CONTRACTOR has no entailment for any additional
compensation and he shall expedite finishing the remaining activities because
also COMPANY is carrying a burden due to CONTRACTOR's frequent delays.

COMPANY
would like to remind CONTRACTOR of its letter no. XXXXX stating that
CONTRACTOR is obligated to take all care and custody of the work and it shall
remain with CONTRACTOR until such Works has been accepted in writing by COMPANY
and shall there upon pass to COMPANY.
Nevertheless,
CONTRACTOR is reminded that he shall carry his responsibilities through his Constructability
Program Manager to plan, coordinate, execute all of interfacing constructability
matters with Other Contractors as stated in Contractual Schedule B Para
4.9.2.6. and 4.9.4.
COMPANY in its above reference letter provided CONTRACTOR the
contact information of Dodsal Co. and urged him to collectively coordinate
their construction activities.
In the end, COMPANY acknowledges CONTRACTOR's concern that Dodsal Co. changed
the method of excavation from thrust boring to open cut. However, CONTRACTOR shall be
reminding that the size of the area impacted is less than 100LM of pipeline
where CONTRACTOR did not yet complete the remaining activities inside the Royal
Commission Corridor and OCI at large. Therefore, pushing back to the end this
portion would be the effective plan with serious effort to complete the
remaining road crossings and remaining construction activities inside YNGL and
Samref.

GRO on 08th March, 2014.

order request is overdue beyond the final submittal date.
COMPANY hereby urges CONTRACTOR to submit the proposal for the

Please be informed that Yanbu Royal
Commission (YRC) agreed to renew the construction permit. And also agreed to
finalize the pending open cut permit for road crossing no. 6.
Please, have your designated GRO to
coordinate with YRC to issue the apply for the renewal to issue the required
permits and complete all remaining activities within the YRC Corridor.
In the meantime, Contractor shall
be reminded that all inside plants (YR, Jetty, YNGL, Samref) activities are
still behind schedule progressing slowly with very undersourced resources; in
which came different to Company's expectation as mentioned earlier in
referenced letter. Contractor shall act and progress to complete all OCI Scope
by end of March 2013.

This is to notify CONTRACTOR that COMPANY has received two
violations for two of Contractor's personnel who were violating the driving
rules and not fasten their safety belts while driving inside YNGL plant.
As per the Contract, CONTRACTOR and its employees shall comply at
all times with all applicable Saudi Arab Government safety regulations and all
SAUDI ARAMCO General Instructions and other related rules and regulations.
Therefore, Contractor MUST adhere to project safety rules and regulations and
any violation or failure is not accepted.

To prevent such reoccurrence, COMPANY instructed
CONTRACTOR's personnel in charge such as construction manager, safety manager, and
two violators to attend an investigation meeting which is scheduled on Wednesday,
7th December 2016 at 10:00 am in PMT Conference Room # 1.
CONTRACTOR shall immediately take all necessary corrective actions
and/or implement all necessary measures at contractor's expense to prevent such
reoccurrence.
CONTRACTOR is strictly advised to comply with Company
rules and regulations and avoid any further violations that may jeopardize
project delay.

Company
still maintain its expressed position in its letter no. XXXXX that
Contractor as per contract is obligated to take all care and custody of the
WORK and it shall remain with Contractor until such Work has been accepted in writing

Contractor claims due to inability to manage, secure and take custody of the
work area.
Company
from its supportive side delivered your complain to the other party (Dodsal Co.)
through its Sponsoring Organization requesting him to meet with you. As per
Company's knowledge, a meeting on Nov. 09, 2016 was conducted directly between
you and the other party (Dodsal Co.).
Upon
this point, Company finds its support is sufficient for Contractor to resolve
his matters with others; thus, Company concludes this subject to be closed.

subject contract, Paragraph 10, you are hereby requested to submit your
detailed technical and commercial proposals in duplicate originals, including a
detailed breakdown of cost and schedule changes associated with this Change
Order Request (COR # 083IK) by Thursday, November 24, 2014.
Before submitting the detailed proposal to the bid box,
CONTRACTOR is hereby requested to submit the scope of work and bill of
quantities related to the subject change no later than Thursday, November 17,
2014 to Luberef PMT for Luberef PMT review and agreement.
